Terms and Conditions of Sale

  1. A deposit of 50% of the purchase price of the goods is required with every order placed prior to work commencing.
  2. Prices quoted are Ex Works, MOTTO Warehouse, Cape Town. (Shipping and delivery, locally and overseas, can be arranged.)
  3. Packing of the goods is included. We can arrange for goods to be packed by professional packers.
  4. Payment of the balance of the purchase price is due within fourteen (14) days of the Customer being informed in writing that the goods are available for collection or shipment.
  5. In the event of the Customer failing the make due payment of the balance of the purchase price within the fourteen (14) days as set out above, such failure will constitute a material breach of the contract of sale which contract will thereupon automatically terminate and the deposit paid by the Customer will be forfeited in favor of MOTTO in the form of liquidated damages.
  6. The goods remain the Property of MOTTO until full payment of the purchase price is received, whereupon ownership will pass to the Customer.
  7. Once the goods have been removed from MOTTO’s premises by or on behalf of the Customer, all risk of loss or damage to the goods will immediately pass to the Customer and such goods will be deemed to have been so removed in good order.
  8. The Customer will be responsible for the necessary insurance on the goods once the risk has passed as set forth in paragraph 7 above, however, MOTTO can arrange insurance on the Customer’s behalf upon receipt of a written request to that effect.
  9. Custom-made orders will require payment of the full purchase price prior to the manufacture thereof. Custom-made orders cannot be exchanged. (A custom-made order is one that deviates from the goods listed in the MOTTO catalogue).
  10. Specific electrical requirements must be confirmed in writing with the order. (There may be additional charges for such requirements.)
  11. MOTTO will not give refunds or issue credit notes on any goods sold, however, upon request from the Customer, MOTTO may in its own discretion endeavor to sell unwanted goods on behalf of a Customer.
  12. Manufacturing times are subject to availability of materials used. Normal manufacturing time is 4 – 8 weeks after receipt of confirmed order and the deposit as set forth in paragraph 1 above. Large volume orders may require longer lead times. This will be confirmed prior to confirmation/acceptance of order.
  13. Unless otherwise specified, all Goods will be shipped unassembled in order to limit freight charges.
  14. Freight quotes are airport to airport.
  15. Regarding the finished product, MOTTO always use the best leather available at the time of manufacture and can not be held responsible for any joins found in the leather as a result of the manufacturing process (Joins appear when we cut away markings on leather or skins are smaller than the furniture surface).
